I think most companies don’t take the time to do this. makes you wonder if they are intentionally obscuring some material changes in the TOS.

What's New in Figma's Terms of Service (June 18, 2025 Update)

Figma has updated its Terms of Service, and here's a breakdown of the important changes, especially for those using free and Starter plans:

Clearer Rules for Everyone (including Free & Starter Plans)

• Starter Plans are Officially Covered: It's now crystal clear that these terms specifically apply to Starter plans, in addition to Professional plans and Figma's websites.

• Your Role in Account Security (2FA): Figma now emphasizes that it supports two-factor authentication (2FA). If you don't use it and your account gets unauthorized access, Figma won't be responsible for any issues that could've been prevented by 2FA. This means you have a part to play in keeping your account safe.

• How Figma Uses Your Content: Figma has spelled out that it can use your "Customer Content" (like designs you upload) specifically to provide the services, keep them running smoothly, secure them, fix bugs, and ensure quality. It's a more direct statement about how they use your stuff for operational purposes.

• Figma's New (Limited) Promises: While Figma still says its services are "as is," it now explicitly promises a few things:

  • They'll provide access to the Figma Platform and support services as described in their documentation.

  • They'll use "industry standard measures" to protect the platform from viruses and other malicious code.

• Credits Now Expire: If Figma gives you any credits (for promotions or other reasons), they will now expire after one year unless Figma says otherwise when they're issued.

• Getting Your Content Back After Termination: If your account is terminated, Figma will now make your "Customer Content" available for you to retrieve for 30 days. After that, they might delete it. This gives you a specific window to download your work.

• Getting Notified About Big Changes: Figma now commits to trying to give you reasonable advance notice if they make any changes to the terms that significantly affect your rights or how you use the services. This notice could come through the Figma platform, their website, or email.

• New Steps for Disputes: If you have a serious dispute with Figma that you can't resolve directly, there's a new "Pre-Arbitration Letter" step you both have to go through at least 60 days before starting formal arbitration. Also, the company that handles arbitration has changed from AAA to NAM.

• Patent Assertion Entity Definition Broadened: The definition of what Figma considers a "Patent Assertion Entity" has been slightly broadened. This means the scope of entities restricted from asserting patent claims against Figma has potentially increased.

Important for Paid Plans (including Starter Plans)

• Clearer Pricing Change Rules: For paid plans, if Figma changes the price of your existing recurring subscription, it will usually take effect at your next renewal. However, if they say a price change will happen during your current subscription period and you don't agree, you can cancel for that specific service and get a pro-rata refund for the unused portion, as long as you notify them within 30 days. This gives you more options for mid-term price hikes.

• Protection if Services are Discontinued: If Figma discontinues a service you're paying for during your subscription, they will now either move you to a similar service or give you a pro-rata refund for the remaining time on your subscription. This is a significant protection that wasn't there before.

In essence, these updates bring more clarity and a few new protections for users, especially those on paid plans, while also emphasizing user responsibility in areas like account security.
